1. What Content is Not Permitted?

The following content may not be stored, shared, or made available via BilliardCloud:

  • content that violates applicable law, in particular criminal law, personality rights, copyright, trademark, or competition law;
  • content that is harmful to minors, pornographic, racist, glorifies violence, or constitutes incitement;
  • terrorist propaganda or incitement to crime;
  • personal data of third parties without legal basis;
  • harmful software (viruses, malware) or content used to distribute such software;
  • content that impairs or endangers the functioning of the Platform.

2. Who Can Report Content?

Any natural or legal person can report content they consider illegal. The reporting process is low-threshold and does not require legal expertise.

3. How Do I Report Content?

Please send your report by email to:

content-report@billiardcloud.com

Please include in your report:

  1. What is the content? Description (e.g. club name, member name, type of data – photo, text, logo).
  2. Where is the content? Precise location (URL, screenshot, path in the app).
  3. Why is the content illegal? Reasons – what violation has occurred (copyright, personality rights, etc.).
  4. Who are you? Name, email address, optionally the legal basis of your complaint (e.g. own copyright, own photograph, power of attorney).
  5. Statement of accuracy: A statement that the information provided is true and complete to the best of your knowledge.

4. What Happens After Your Report?

  1. Acknowledgement: We confirm receipt of your report typically within 24 hours by email.
  2. Review: We review the reported content carefully, in a non-arbitrary and objective manner, with due regard to the fundamental rights of the parties involved.
  3. Processing time: Review is usually completed within 7 business days. Complex cases or required statements from affected parties may take longer; we will keep you informed.
  4. Decision: We decide whether action is required. Possible actions include: removal of content, blocking access, restricting visibility, warning the Customer, and in severe cases termination of the contractual relationship.
  5. Information: Both you as reporter and the affected Customer will be informed of the decision in text form. The decision contains a statement of reasons and information on remedies.

5. Information on Measures (Art. 17 DSA)

If we remove content, block access, or restrict it, we inform the affected Customer in text form. The information includes:

  • the specific measure and its territorial and temporal scope;
  • the facts and circumstances that led to the decision;
  • the legal or contractual basis of the measure;
  • information on the internal complaint procedure, out-of-court dispute settlement, and judicial recourse.

6. Complaint Procedure

If you are a Customer affected by a measure and consider it unjustified, you can file a complaint within 14 days of receiving the measure notification.

Complaint channel: Email to content-report@billiardcloud.com with the subject "Complaint [Case Number]". Please justify your complaint and attach evidence where appropriate.

We review complaints carefully and communicate the result within 14 business days. If the original measure is reversed as a result of your complaint, we restore the content without delay and inform the reporting party where appropriate.

7. Out-of-Court Dispute Resolution

You have the right to refer matters to an out-of-court dispute resolution body certified pursuant to Art. 21 DSA, where such bodies are available for our sector. We will publish corresponding information on this page once suitable bodies are available.

8. Crime Reporting for Life-Threatening Offences (Art. 18 DSA)

Where there is suspicion of crimes that directly threaten the life or safety of persons, we forward all necessary information to the competent law enforcement authorities without delay.

9. Abuse of the Reporting System

Manifestly abusive reports may result in the reporting person being blocked from future reports (analogous to Art. 23 DSA). We reserve legal action in cases of repeated abuse.

11. Amendments to this Content Policy

We reserve the right to amend this Content Policy in case of changes in the legal framework or the Platform. Material changes will be announced to Customers with reasonable notice.
